These Terms of Use govern your access to and use of mediumbrand.com and any content, features or submissions made available through it (the "Site"), operated by MEDIUM™ ("MEDIUM", "we", "us") from Calgary, Alberta, Canada. By using the Site you agree to these Terms. If you do not agree, please do not use the Site. The Site is currently a pre-launch preview: no products are offered for sale and no orders can be placed.
1. Using the Site
You must be at least eighteen years old to use the Site or make a submission. You agree not to:
- Use the Site for any unlawful purpose, or in breach of these Terms.
- Submit content that is false, defamatory, harassing, hateful, obscene, or that infringes anyone's rights.
- Submit personal information about another individual without that person's knowledge and consent.
- Attempt to gain unauthorised access to the Site or interfere with its operation.
- Scrape, harvest or systematically extract content or personal information from the Site.
- Misrepresent your identity or affiliation with any person or organisation.
2. Story Submissions
The Story Builder lets you record a chapter of your life and generates a Story Board. Using it is voluntary and free.
A submission is not a publication.
Completing the Story Builder does not make your story public. If you ask to be considered for a feature, we will contact you and obtain your explicit written confirmation of the final wording, the photograph and any reference to another person before anything is published.
Submitting a story creates no obligation on either of us. We are not required to publish it, and you are not required to allow us to.
3. Your Licence to Us
You keep ownership of everything you submit. Your story is yours.
Where you have given us explicit written confirmation to publish a story, you grant MEDIUM a non-exclusive, royalty-free, worldwide licence to reproduce, display, adapt for formatting, and distribute that story and its accompanying photograph on the Site, in our email communications, in printed materials, and on our social media channels, for the purpose of presenting the story as part of the MEDIUM community.
This licence is limited to the version you confirmed, and it ends when you ask us to remove your story, except for copies already distributed in email or print, or archived by third parties beyond our control. We will not sublicense your story for use by another business, and we will not use it in paid advertising without asking you separately.
We do not pay for story submissions. If your story is selected as a featured story, any MEDIUM product provided to you is a gift offered at our discretion, not payment for a licence.
4. Your Assurances
When you make a submission, you confirm that:
- The story is true to the best of your knowledge and is your own account.
- You own or have permission to use any photograph you upload.
- Every person clearly identifiable in the photograph consents to its use as described in these Terms.
- Any other person named or clearly identifiable in your story is comfortable being referred to.
- Your submission does not infringe any copyright, trademark, privacy or other right.
- You are not subject to any confidentiality obligation, settlement agreement or court order that your submission would breach.
- No photograph you upload depicts a minor.
5. Editorial Discretion
We select stories at our sole discretion, and we may decline any submission for any reason or none. We may make light edits for length, clarity, spelling and formatting — but we will not change the substance of what you said, and you will see and confirm the final version before it appears.
We may remove any published story at any time, including where we later have reason to doubt its accuracy, where a third party raises a legitimate concern, or where continued publication may cause harm.
6. Removing Your Story
You may withdraw your story at any time and for any reason, without explanation. Email us and we will remove it from the Site promptly, and in any event within ten business days. We will also remove it from future communications and materials.
We cannot recall emails already sent, printed materials already distributed, or copies made by third parties, search engines or internet archives.
7. Our Intellectual Property
The MEDIUM name, the MEDIUM triangle mark, "Stories Worth Wearing", the six-chapter framework, and all site design, photography, text, product designs and other materials are owned by MEDIUM or licensed to us, and are protected by Canadian and international intellectual-property law.
You may view and share links to the Site. You may not copy, reproduce, republish, sell or create derivative works from our content without our prior written permission, other than personal non-commercial use of a Story Board you created. Your Story Board is yours to keep, print and share.
8. Pre-Launch Information
The Site currently previews products that are in production or final sampling. Accordingly:
- No product on the Site is currently offered for sale, and no order can be placed.
- Any price shown is indicative and may change before launch.
- Specifications, materials, colours and availability may change.
- Timing references such as "Fall 2026" are estimates and are not commitments.
- Some imagery is representative and may differ from final production pieces.
Joining the Founding List creates no obligation to buy anything and reserves no product.
9. Emails
By joining the Founding List you consent to receive commercial electronic messages from MEDIUM. Every message includes an unsubscribe link, and you may withdraw consent at any time. Our handling of your email address is described in our Privacy Policy.
10. Third-Party Links
The Site may link to third-party websites and services. We do not control them, we are not responsible for their content or practices, and a link is not an endorsement. Their terms and privacy policies govern your use of them.
11. Disclaimers
The Site and its content are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, timely, secure or error-free, or that any defect will be corrected.
Stories published on the Site are the personal accounts of the individuals who submitted them. They are shared for inspiration and reflection. They are not advice — medical, psychological, legal, financial or otherwise — and they do not represent the views of MEDIUM. If you are struggling, please speak with a qualified professional.
12. Limitation of Liability
To the fullest extent permitted by law, MEDIUM and its directors, officers, employees and contractors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or relating to your use of the Site or any submission, whether based in contract, tort, negligence, strict liability or otherwise, even if we have been advised of the possibility of such damages.
Our total aggregate liability arising out of or relating to the Site or these Terms will not exceed one hundred Canadian dollars (CAD $100).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. Where that is the case, the above exclusions and limitations apply only to the extent permitted, and nothing in these Terms limits liability that cannot lawfully be limited.
13. Indemnity
You agree to indemnify and hold harmless MEDIUM and its directors, officers, employees and contractors from any claim, demand, loss, liability or expense (including reasonable legal fees) arising from your breach of these Terms, your submission, or your violation of any law or the rights of any third party.
14. Governing Law
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction of the courts of Alberta, subject to any non-waivable rights you may have under consumer-protection law in your place of residence.
15. Changes to These Terms
We may update these Terms from time to time, particularly as MEDIUM moves from pre-launch to selling. The revision date at the top of this page reflects the current version, and continued use of the Site after a change constitutes acceptance. If a change materially affects a story you have already submitted, we will contact you directly.
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver of it.
